This privacy policy applies to any personal information which you give to Ilkley Lawn Tennis & Squash Club (“ILTSC”). In using this website and entering your personal data you consent to us collecting and using your personal data in accordance with this privacy policy.

When using the site you may be asked to enter personal data such as your name, address, delivery address, e-mail address, telephone number. We may also collect personal data about you from telephone conversations, e-mails and written and verbal communications.

Any personal data that we collect (with your consent) will be used and recorded by us in accordance with current data protection legislation and this privacy policy. We will use your personal data mainly for record keeping purposes and in order to provide our services and products to you. This may involve us sending you information about us, our affiliates and associated companies and organisations including but not limited to promotional and/or marketing material about our products, services and offerings.

We may also create an individual profile for you so that we can inform you of services, products, events or special offers that may be of interest to you. We may use your personal data to analyse customer/user behaviour and characteristics in order to measure interest in and use of the various areas of the site with a view to improving the site and to inform advertisers of such information as well as the number of users that have been exposed to or clicked on their advertising banners. We will provide only aggregated and therefore anonymous data to third parties for this purpose.

  1. ONLINE PURCHASES OF CREDIT

 

Online purchases of credit and Court Bookings

  1. Except in accordance with paragraph 20 there are no rights of refund and you acknowledge that the cancellation rights contained in the Consumer Protection (Distance Selling) Regulations 2000 (as amended) do not apply to the services we offer.
  2. The Court Booking System Guidelines contain details of how to book a court and purchase credit. We advise you to read these Guidelines before you proceed to book a court/purchase credit.
  3. Once you have made the computerised court booking online, or ILTSC’s receptionist has done so on your behalf, it will be shown on the computer screen immediately. The computer screen will inform you prior to your making the booking if the court and time you wish to book is unavailable.
  4. The price of the courts/credit are those displayed on the Website from time to time, during the booking process, except in cases of obvious error. In addition to the price of credit, a Card Handling Fee in consideration for processing your credit card transaction with its bankers, is payable on online credit card transactions, and this will be notified to you during the ordering process. All prices and fees include any applicable Value Added Tax. All prices are in pounds sterling.
  5. Credit/debit card payments can be made by any method specified on the online booking system. SECPAY/Barclaycard, as agents for ILTSC will deduct your payment from your card at the time it processes your credit/debit card transaction
  6. When you purchase credit/make a court booking via this Website, all transaction details that you provide (including your name and credit/debit card details) will be held and used in accordance with our Privacy Policy and will be encrypted using secure technology. We will take reasonable steps to safeguard transaction details, but you acknowledge and agree that the use of Internet booking can never be completely secure. Subject to paragraph 3 (“Your statutory rights”), unless either SECPAY/Barclaycard and/or ILTSC has been negligent, they shall not be liable for any loss or damage you may suffer as a result of the loss of confidential or personal information provided via this Website.
  7. For the avoidance of any doubt, where a transaction is not completed for whatever reason, SECPAY/Barclaycard will not have levied its Card Handling Fee, as your credit/debit card transaction will not have been completed.
  8. The sale of credit and of court bookings is subject to availability. Your request for credit/to make a booking is an offer to purchase and ILTSC retains the discretion to refuse your order. If ILTSC accepts your order, we will display a confirmation page on your screen at the end of the ordering process, and at this point there will be a contract. Such a contract will be governed by English Law and will be subject to the non-exclusive jurisdiction of the English Courts. We recommend that you print out a copy of the confirmation page and/or confirmation e-mail for your records.
  9. You should check in with ILTSC’s reception and register your key fob when you arrive for your court booking. You represent and warrant that any credit and booking you purchase are for personal use only, and that they are not purchased as part of any form of for profit business or commercial activity, unless we have expressly authorised otherwise in writing.
  10. It is your responsibility to check your credit purchase and court booking as we are under no obligation to rectify mistakes after a contract has been formed. Please also note that we are not under an obligation to provide the booking to you at the incorrect (lower) price, even after the confirmation page has been displayed and the confirmation email has been sent to you, if such a pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.
  11. If a booking has to be cancelled or rescheduled (for whatever reason), we will use reasonable endeavours to notify you of the cancellation or rescheduling. You can cancel a court booking at any time before the start time of the booking. If you cancel it more than 48 hours before the booking is due to take place then you will receive a full refund to your account. If the cancellation is made at a later point then no refund will apply, unless the court is rebooked by another member.
  12. We accept no responsibility for any personal property that is brought to ILTSC.
  13. Price and availability information is subject to change without notice.
  14. We reserve the right to refuse admission should you breach any of these Terms and/or ILTSC’s Rules and we may on occasions have to conduct security searches to ensure your safety.

Non-compliance with these Terms

  1. We reserve the right to investigate any suspected non-compliance with these Terms. If we believe that a violation of these Terms (or any of the rights identified in these Terms) has occurred, we may suspend or bar your access to this Website or take such other corrective action as we deem appropriate.

Limitations on ILTSC’s liability to you

  1. We will use reasonable endeavours to ensure the accuracy of any information on this Website, but we make no representation or warranty of any kind that this Website or any of its contents will be accurate, current, complete, or error-free. Unless we have been negligent, we accept no liability of any kind for any loss or damage arising from action taken in reliance on information on this Website.
  2. We will use reasonable endeavours to exclude computer viruses from this Website, but we make no representation or warranty of any kind that this Website or any of its contents will be free from computer viruses introduced by third parties. Unless we have been negligent, we accept no liability of any kind for any loss or damage caused by computer viruses.
  3. Subject to paragraphs 3 (“Your statutory rights”) and 28, in the event that you purchase credit/make court bookings online via this Website, our liability (whether in contract, tort (including negligence), statute or otherwise) arising out of or in connection with that purchase shall be limited to the price paid by you for those courts/credit.
  4. Subject to paragraph 3 (“Your statutory rights”), we will not be liable to you for any:
    1. loss of profits;
    2. loss of revenue;
    3. loss of anticipated savings;
    4. loss of business;
    5. loss of opportunity;
    6. loss of data;
    7. loss of or damage to goodwill or reputation; or
    8. any indirect or consequential loss or damage,

whether arising under contract, tort (including negligence), statute or otherwise.

Events outside our control

  1. We will not be liable or responsible for any failure to perform, or delay in the performance of, any of our obligations that are caused by events outside our reasonable control.

Jurisdictional issues

  1. This Website is directed only at users in the United Kingdom and you may only use this Website to purchase credit/make a court booking if you are domiciled in the United Kingdom. If you access this Website from outside the United Kingdom, you do so at your own initiative and risk, and you are responsible for compliance with any applicable local laws.
  2. These Terms and your access to or use of this Website are governed by the relevant law listed below, and any dispute arising in connection with this Website shall be subject to the non-exclusive jurisdiction of the relevant court listed below:
